These Terms of Service ("Terms") govern your access to and use of products, services, and website (collectively, the "Services") provided by RCT Technologies LLC ("RCT," "we," "our," or "us"), including products sold under the SolarPerg™ brand.
By purchasing, receiving, or using any SolarPerg product or related Services, you agree to be legally bound by these Terms.
1. Scope of Services
RCT Technologies LLC is the manufacturer and seller of SolarPerg systems.
We may provide:
- Equipment (SolarPerg system)
- Delivery services
- Optional installation services (limited availability, including Houston, TX)
- Optional permitting and interconnection support services
Unless explicitly agreed in writing, SolarPerg is sold as an equipment kit only, not a fully installed system.
2. Orders, Pricing, and Payments
- All orders are subject to acceptance and availability
- Pricing may change at any time prior to order confirmation
- Taxes, delivery, installation, permitting, and electrical work are not included unless explicitly stated
Preorders
- Deposits may be applied toward final purchase
- Preorders are refundable until converted into a final order
3. No Return / No Refund Policy
Due to the customized, large-format, and engineered nature of SolarPerg systems: ALL SALES ARE FINAL UPON DELIVERY AND ACCEPTANCE.
- No returns, refunds, or exchanges are permitted after delivery
- Exceptions may be granted only at the sole discretion of RCT management under extraordinary circumstances
- Shipping and logistics costs are non-recoverable and are a material basis for this policy
This policy does not limit any applicable limited product warranty.
4. Delivery and Transfer of Risk
Upon delivery and signed acceptance, full custody, control, and risk transfer to the customer. Customer assumes responsibility for:
- Storage
- Handling
- Protection
- Use
RCT is not liable for any damage occurring after delivery, including:
- Weather events
- Improper storage
- Third-party handling
- Installation errors
5. Installation Responsibility
Default Model (Most Customers)
Unless explicitly contracted otherwise:
- Installation is NOT performed by RCT
- Customer is fully responsible for installation
You must:
- Hire a licensed electrician for all electrical work
- Ensure compliance with NEC and local codes
- Ensure structural safety and proper anchoring
Houston / Contracted Installation Exception
Where RCT provides installation:
- Electrical work may be subcontracted to a licensed master electrician
- Structural and installation scope will be defined in a separate agreement
Even in these cases, site conditions and permitting remain customer-dependent. Utility approval is not guaranteed.
6. Electrical Responsibility
- All electrical work must be performed by a licensed professional
Customer is responsible for:
- Permits
- Inspections
- Utility interconnection
RCT is not liable for electrical failures, code violations, or utility rejections. Failure to comply may void warranty.
7. Structural, Wind, and Anchoring Responsibility
SolarPerg is a movable, foldable, free-standing solar structure. You acknowledge and agree to the following terms.
Free-Standing Configuration
- Designed for moderate wind conditions only (~tropical storm range)
- NOT intended for severe or hurricane conditions
Anchoring / Ballast (Recommended)
- Required for higher wind resistance
- Must be designed based on site-specific conditions
Engineering Requirement
- Anchoring, ballast, and footing design must be reviewed by a licensed structural engineer where required
Customer Responsibility
You are solely responsible for:
- Structural safety
- Anchoring or ballast design
- Compliance with building codes
- Safe operation under weather conditions
Wind and Weather Disclaimer
No guarantee is made regarding performance under wind or storm events. Customer must fold and secure system when needed, and anchor system appropriately.
Liability Disclaimer
RCT is not responsible for structural failure, wind damage, improper anchoring, or site-specific conditions.
8. Permitting, HOA, and Regulatory Compliance
Permits
You are solely responsible for obtaining building permits, electrical permits, and inspections. RCT may provide documentation but does not guarantee approval.
HOA Compliance
You are solely responsible for reviewing HOA rules and restrictions and obtaining HOA approval. RCT is not responsible for HOA denial, required removal or modifications, or any HOA enforcement action.
Texas-Specific Acknowledgment
SolarPerg may qualify under Texas solar device protections, but applicability varies. Compliance with Texas Property Code, local ordinances, and HOA rules is your responsibility. No legal exemption or protection is guaranteed.
9. Product Performance Disclaimer
Energy production varies by location, orientation, weather, and shading.
RCT does not guarantee energy output, cost savings, ROI, or tax incentives or credits.
10. Limited Warranty
SolarPerg systems include a limited warranty covering defects in materials and workmanship.
Key Terms:
- Duration: 1 year (unless otherwise specified)
- Coverage: Parts only
- Excludes: Installation labor, electrical work, structural anchoring, damage from misuse, weather, or improper installation
Component-level warranties (e.g., panels, inverters) may be provided by third-party manufacturers.
Warranty may be void if installed improperly, modified, or used outside intended conditions.
11. Limitation of Liability
To the fullest extent permitted by law, RCT Technologies LLC shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of energy production or savings
- Property damage or injury resulting from installation or use
Total liability is limited to the amount paid for the product.
12. Indemnification
You agree to indemnify and hold harmless RCT Technologies LLC from any claims arising from:
- Installation or use of the product
- Structural or electrical issues
- HOA or permitting violations
- Failure to comply with applicable laws
13. Arbitration
All disputes shall be resolved through binding arbitration under the American Arbitration Association (AAA), unless prohibited by law. You may opt out within 30 days.
14. Governing Law
These Terms are governed by the laws of the State of Texas. Jurisdiction: Texas courts.
15. Class Action Waiver
You agree to bring claims individually and waive class actions. You waive the right to a jury trial.
16. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
